The new regulation on the product safety of consumer products

On May 23, 2023, the new General Product Safety Regulation (GPSR) 2023/988 was published in the EU Official Journal L 135 and enters into force on June 12, 2023. The GPSR replaces the previous directive 2001/95/EC. The GPSR regulates the product safety of consumer products and covers, among other things, those products that are not subject to harmonization legislation on CE marking, but is to be applied in addition to directives such as the Toys Directive 2009/48/EC.

In the not too distant future, the respective economic operators will have to adjust to new rules – some of which have been critically evaluated by experts. These include, for example 

  • risk assessments for products that are not currently subject to such requirements 
  • More stringent requirements for sales in the e-commerce sector 
  • Reporting of safety incidents/accidents to authorities 
  • legally binding requirements for product recalls 

Fulfillment service providers are newly included in the group of economic operators.

In addition, the GPSR also amends the Standardization Regulation (EU) 1025/2012 with Article 48 and supplements or amends this regulation.

The predecessor Directive 2001/95/EC will be repealed on December 13, 2024. Consequently, the new GPSR will be legally binding as of December 13, 2024. Economic operators are thus called upon to inform themselves about the corresponding changes and to make adjustments in their compliance processes.
