It's done: The New Machinery Regulation 2023/1230

Legally binding from January 20th 2027

On June 29th 2023, Regulation (EU) 2023/1230 of the European Parliament and of the Council of June 14th 2023 on machinery and repealing Directive 2006/42/EC of the European Parliament and of the Council and Council Directive 73/361/EEC (in short: Machinery Regulation) was published in Official Journal L 165 and is legally binding from January 20th 2027.

It replaces the Machinery Directive 2006/42/EC, which will be repealed on January 20th 2027. It is therefore a key date regulation. There will be no transitional phase where either the Machinery Regulation or the Machinery Directive can be applied.

However, the following articles of the new Machinery Regulation apply from the following dates:

  1. Articles 26 to 42 from January 20th 2024;
  2. Article 50 (1) from October 20th 2023;
  3. Article 6 (7) and Articles 48 and 52 from July 19th 2023;
  4. Article 6 (2) to (6), (8) and (11) and Articles 47 and 53 (3) from July 20th 2024.
