Law on the adaptation of the Product Safety Act and the reorganization of the law on installations requiring inspection in force

In the Federal Law Gazette of July 30, 2021, the Law on the Adaptation of the Product Safety Law and the Reorganization of the Law on Installations Requiring Surveillance was published.

Fortunately, the document is not as long as its title. On 30 pages, it includes not only the Product Safety Law (ProdSG) and the Plant Surveillance Law (ÜAnlG), but also numerous amendments to other laws in the area of legislation applicable to the manufacture and operation of technical products and plants.

Subject to the amendments to the ProdSG, which are scheduled to come into force on May 26, 2022, the law has already entered into force on July 16, 2021. 

  • Article 1 recasts the Product Safety Law and aligns it with the Market Surveillance Regulation (EU-MÜV) 2019/1020 and the already introduced Market Surveillance Law (MÜG). This is intended to avoid the previously competing regulations of the Product Safety Act to the MÜV and MÜG and to provide more clarity.
  • Article 3 creates a separate law on installations requiring monitoring (ÜAnlG), which is intended to support the safe operation of such installations.
  • Article 7 editorially adapts the Operational Safety Ordinance (BetrSichV) to the new ÜAnlG.
