Internal Market Emergency and Resilience Act

The Regulation (EU) 2024/2747 establishes a framework of measures related to an internal market emergency and to the resilience of the internal market and amends Council Regulation (EC) No 2679/98 (Internal Market Emergency and Resilience Act). 

See Recital 1 for the background idea of this regulation: „Past crises, especially the early days of the COVID-19 crisis, have shown that the free movement of goods, persons and services in the internal market and its supply chains can be severely affected. That can have consequences on cross-border trade between Member States, thus creating obstacles to the proper functioning of the internal market. Furthermore, during those crises, appropriate crisis management tools and coordination mechanisms were either lacking, did not cover all aspects of the internal market or did not allow for a timely and effective response to such crises“. 

Perhaps somewhat unnoticed, there are two additional regulations that have amended the familiar “CE Directives and Regulations as well as the GPSR”: 

Regulation (EU) 2024/2748 of the European Parliament and of the Council of 9 October 2024 amending Regulations (EU) No 305/2011 (Construction Products), (EU) 2016/424 (Cableway Installations), (EU) 2016/425 (PPE), (EU) 2016/426 (Appliances Burning Gaseous Fuels), (EU) 2023/988 (Product Safety of Consumer Goods) und (EU) 2023/1230 (Machinery) as regards emergency procedures for the conformity assessment, presumption of conformity, adoption of common specifications and market surveillance due to an internal market emergency 

Directive (EU) 2024/2749 of the European Parliament and of the Council of 9 October 2024 amending Directives 2000/14/EC (Outdoor Noise), 2006/42/EC (Machinery), 2010/35/EU, 2014/29/EU (Simple Pressure Vessels), 2014/30/EU (EMC), 2014/33/EU (Lifts), 2014/34/EU (ATEX), 2014/35/EU (Low Voltage), 2014/53/EU (Radio Equipment) and 2014/68/EU (Pressure Equipment) as regards emergency procedures for the conformity assessment, presumption of conformity, adoption of common specifications and market surveillance due to an internal market emergency 

Accordingly, certain emergency procedures may be applied to specific crisis-related goods - such as the presumption of conformity. The Commission may adopt implementing acts regarding the corrective or restrictive measures to be taken, the procedures to be followed, and the specific requirements for the labeling and traceability of devices placed on the market 

Regulation 2024/2748 shall be applied since May 30, 2026. 

Directive 2024/2749 had to be transposed into national legislation by May 29, 2026, and has also been applicable since May 30, 2026.
