EAEU: Revision of the TR on the restriction of the use of hazardous substances in electrical and electronic equipment planned

TR EAEU 037/2016

The Eurasian Economic Union (EAEU) has published a proposal with amendments to the Technical Regulation on the Restriction of Hazardous Substances in Electrical and Electronic Equipment (TR EAWU 037/2016).

The list of EEE excluded from the scope is to be extended for the following products:

  • Large-scale stationary equipment
  • Large-scale stationary industrial tools

In addition to the six substances already subject to restrictions since March 2020 – namely lead (0.1%), cadmium (0.01%), mercury (0.1%), hexavalent chromium (0.1%), polybrominated biphenyls (0.1%) and polybrominated diphenyl ethers (0.1%) – four more substances are to be added in further approximation to RoHS Directive 2011/65/EU:

  • Di(2-ethylhexyl) phthalate (DEHP) (0.1 %)
  • butyl benzyl phthalate (BBP) (0.1 %)
  • Dibutyl phthalate (DBP) (0.1 %)
  • Diisobutyl phthalate (DIBP) (0.1%)

To the 12 product categories covered by this Technical Regulation, one additional category shall be added:

  • Other electrical and electronic equipment that cannot be assigned to any of the categories already mentioned.

In addition, recycling requirements for electrical and electronic products are included. These requirements are based on the European Directive 2012/19/EU on waste electrical and electronic equipment, better known as WEEE. Accordingly, products must be marked with a crossed-out wheeled garbage can (without bars).


A public consultation on the project is scheduled from Nov. 19, 2021, to Jan. 21, 2022. Provided the amendments are officially adopted by the Eurasian Economic Union Council thereafter, the amendments will enter into force 180 days after the date of official publication of this decision.
